Case Two, Ohio. Multiple officers have pursued a stolen van, which finally pulls over. In an obviously rehearsed strategy, the four car thieves inside bail out and run in four different directions. The soon-to-be-defendant officer chases one of them, gun in hand as department policy suggests for such felony stops. Holding his 9mm out to the side away from the large male suspect, the cop grabs him by the back of the clothing with his free hand. Flailing wildly, the suspect’s right hand strikes the pistol, and a shot is fired. The bullet strikes the suspect in the head, killing him instantly.
The dead car thief turns out to be in his early teens. While the officer is cleared by the criminal justice system, the family of the deceased files a lawsuit, alleging wrongful death.
My research and analysis showed that the officer had been taught to hold his service pistol with his thumb straight, pointed toward the muzzle. The flailing hand of the suspect came in from the right, striking the front of the slide and driving the front of the gun leftward. The officer’s straight thumb was parallel to the trigger. The impact of the young suspect’s hand hitting the gun did two things: it drove the gun the officer had been holding far to the right, far left…into direct alignment with the suspect’s head. At the same time, it twisted the pistol inside the right hand to the left, bringing the trigger into violent contact with the officer’s thumb and…BANG!
In a “perfect storm” of events the officer could not possibly have anticipated, the suspect’s own actions had driven the striker-fired pistol’s trigger against the thumb, causing the shot to be fired into his own head.
Shortly after I gave a sworn deposition to plaintiff’s counsel, the plaintiffs decided to accept a settlement. The officer went back to his career. Nothing could bring back the young man who had died as a result of his own bad choices that began with participating in grand theft auto, and ended with an unintended gunshot that he could not have anticipated, either.
